Photo access, usage and licensing terms
This page is referenced from the metadata embedded in the photographs themselves. It states the conditions under which images from the archive may be used.
Access to the stock database
Access is granted to professional users — magazine and publishing staff, picture editors, advertising creatives and similar. Register in the appropriate section of the stock database; a user name and password follow, usually within 24 hours, and are required for direct high-resolution download.
Searching the database
Search by geographic area or description, or use the keywords listed on the search page. All names are generally in English, with some Italian translation.
Preview, low-resolution and high-resolution files exist for every image. For a single image, download the size you need from the preview window. For several, add them to the lightbox and download in batch.
Not all visible images are available for direct download, because of pending usages or stock agency commitments. In those cases, ask about the possibilities for your specific intended use.
A high-resolution request is considered proof of usage.
Copyright and licensing terms
All photographs and visual materials supplied from the Andrea Pistolesi archive are original creative works protected by applicable copyright laws and international copyright conventions.
Andrea Pistolesi is the sole author and copyright owner of the images supplied. Any representation of these images by authorized agencies or distributors does not affect or transfer copyright ownership.
Unless expressly agreed otherwise in writing, no copyright is transferred through any transaction. The client is granted only the specific license of use described in the applicable invoice.
The license granted is limited to the agreed purpose, media, territory, duration, and scope of use. Any additional use, republication, redistribution, reuse, adaptation, licensing to third parties, or use beyond the agreed terms requires prior written authorization from Andrea Pistolesi and may be subject to additional licensing fees.
No exclusivity is granted unless expressly stated in writing. In the absence of a written exclusivity agreement, Andrea Pistolesi reserves the right to license the same images to other parties.
Any exclusive rights, whether limited or unlimited in duration, must be agreed in writing and are subject to separate compensation.
Whenever technically and editorially feasible, image credits shall appear as: © Andrea Pistolesi
The client may not assign, sublicense, transfer, distribute, or otherwise make the images available to third parties without prior written authorization from Andrea Pistolesi.
Images may not be altered, manipulated, or used in a manner that prejudices the artistic integrity of the work or the reputation of the author. Reasonable technical adjustments necessary for reproduction or publication are permitted.
Digital files supplied remain the intellectual property of Andrea Pistolesi. The client is responsible for safeguarding such files and preventing unauthorized use, distribution, or reproduction.
Responsibility for the final use of the images, including compliance with applicable laws, regulations, permissions, releases, trademarks, property rights, privacy rights, and other third-party rights, rests solely with the client. Where available, model releases and/or property releases may be provided upon request.
Unless otherwise specified, images from the Andrea Pistolesi archive are supplied primarily for editorial, documentary, educational, and cultural purposes and should not be assumed to include unrestricted commercial advertising rights.
These terms shall be governed by Italian copyright law and applicable international copyright conventions.
Any dispute arising from or relating to the licensing of these images shall be subject to the exclusive jurisdiction of the Court of Florence, Italy.
